The Family Educational Rights and Privacy Act of 1974 grants to students certain rights, privileges, and protections relative to individually identifiable student educational records which are maintained by the College. Specifically, McDaniel College has adopted the following general guidelines and specific procedures on the access to and release of student records.
Definitions McDaniel College may disclose “Directory Information” without the student’s consent. Directory information is defined as: name, dates of attendance, previous institutions(s) attended, major field of study, awards, honors, (includes Dean’s List), degree(s), past and present participation in officially recognized sports and activities, height and weight of athletes, hometown and photographs.
"Educational Records" means those records, files, documents and other material which contain information directly related to a student and are maintained by McDaniel College or by any person acting for McDaniel College. Not included in the term "educational records" are records of instructional, supervisory, and administrative personnel and records created or maintained by a physician, psychiatrist, psychologist, or other recognized professional or para-professional acting in his/her professional capacity.
Release of Directory Information Only directory information may be released in response to telephone inquiries. College personnel are not required, though, to release any information over the phone. All requests should be handled with discretion.
Right of College to Refuse Access McDaniel College reserves the right to refuse to permit a student to inspect the following records:
The financial statement of the student's parents.
Letters and statements of recommendation for which the student has waived his or her rights of access, or which were placed in file before 1/1/75.
Confidential letters and statements of recommendation concerning admission, employment, honor or honorary recognition if the student has signed a waiver of his/her right of access.
Records being withheld for failure to meet financial obligations.
Disclosure of Educational Records to Students Any student is entitled access to his/her educational records. This includes the right:
To inspect and review the contents of those records.
To obtain copies of those records at the cost of reproducing those copies.
To a response from the custodian of the records to reasonable requests for explanations and interpretations of those records.
To an opportunity for a hearing to challenge the content of those records.
Disclosure of Educational Records to Parents Although routine reports will be mailed directly to the student, parents of dependent students (as defined in Section 152 of the Internal Revenue Code) may have access to students' educational records without their prior consent.. Non-traditional undergraduate students (those over the age of 24) and graduate students will be considered independent in this respect.
Disclosure of Educational Records to Third Parties McDaniel College will disclose information from a student's educational records only with the written consent of the student, EXCEPT:
To school officials who have a legitimate educational interest in the records.
To certain officials of the U.S. Dept. of Education, the Comptroller General, and state and local educational authorities, in connection with certain state or federally supported education programs.
To comply with a judicial order or a lawfully issued subpoena, only after a reasonable effort has been made to notify the student involved of such order.
To appropriate parties in a health or safety emergency.
To accrediting agencies if the information is necessary to the accrediting organization in order to carry out their accrediting function.
Destruction of Records Disciplinary, college activity, and various other records are periodically destroyed. The college assumes no obligation to provide the student the information contained in such records following their destruction.
